1. Acceptance and Agreement to Terms

These Terms (“Terms of Service”) are the terms upon which Mansoor Ahamad Ali Mohamed trading as “WYBE” (“WYBE”, “us”, “we”, “our”) grants you a right to access, or use, our services provided by us as described in this Agreement, our products, digital content and Website located at https://wybe.fit.

By engaging any of the services below, submitting an intake form for the purpose of arranging a paid service, or arranging a payment for a service by browsing this Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Website or arrange services with us.

2. Services Description

WYBE offers to provide the following services upon payment of the fees as shown on our Website and the scope confirmation forms:

• Work Out Program – 3 month / 6 month / 12 month digital workout program and online consultation service (digital work out program is a digital product emailed as a PDF).
• Fitness Consultation – 1x1 assessment of your body posture and technique of the exercises that is chosen and to give correct scientific biomechanics form and technique to perform the exercise.
• Nutrition Consultation – 1x1 assessment and discussion of human performance nutrition, your macro and micro nutrient targets, vitamins and minerals and supplementation, if needed.
• Personal Training – 1x1 personal training within the UAE on a limited and selective basis by advance appointment only.

The number of sessions (for personal training, nutrition and fitness consultations) as well as their duration shall be determined by WYBE upon commencing of the services on a case by case basis with the right to adjust the content of each session individually, depending on your needs, or your condition and safety on that particular day.

3. Health & Safety Disclaimer

WYBE is a personal coaching, training and sports nutritionist brand. Mansoor Ahamad Ali Mohamed is a REPS level 4 personal trainer and human performance nutritionist, but is neither a doctor nor a physiotherapist, nor is he registered as a dietitian.

The information, advice (whether verbal or written) or recommendations which we give, or which are contained on our programs, training notes, Website or otherwise, including any information from WYBE that you choose to review, should not be regarded as medical advice, diagnosis or treatment. If you consult us and have medical conditions, pregnancy, injuries, are on medication, have any concerns or doubts, it is your responsibility to speak with your doctor or medical professional before engaging in our services.

You represent and warrant that you are in good health and that you participate in our services at your own consent.

4. Payment & Fees

Unless otherwise agreed in writing, the prices stated are exclusive of all taxes and duties payable in the currency selected at the time of purchase (USD). Payment for all the services is made in advance.

WYBE reserves the right to change the price list at any time. You agree that WYBE shall not be obliged to pay any refunds for services rendered or where a booking was cancelled too late, as per section 5 below. You further agree that WYBE shall be entitled to charge late payment fee on any outstanding balance payable to WYBE by you.

The payments for WYBE services will be collected by third party processors (please see our Privacy Policy for details). WYBE does not store any card information at any time of processing.

5. Cancellations, Rescheduling, Refunds

In Person Training

WYBE’s personal training sessions are subject to the following terms and conditions which are considered as a part of the Services provided.

Each personal training session booking is valid for one month, used or unused. Please note that personal training sessions cancelled or re-scheduled 24h in advance will not be charged and can be rescheduled without penalty. Whereas, personal training sessions cancelled or re-scheduled within 24h of the scheduled start time will be non-refundable and non-re schedulable. There is no freezing of sessions allowed except in a personal medical emergency or if you have to migrate from UAE to another country, upon providing proof and being approved by WYBE.

Fitness and Nutrition Consultations

A request to reschedule more than 24h in advance will be granted without any charges. A cancellation or a request to reschedule within 24h of the scheduled start time will be charged as a full payment.

Digital Training Programs

Digital training programs are custom written and non-refundable after submission of the intake form and building the program.

Refunds

If WYBE agrees to a refund, this will be processed to the payment method used to make the original payment. A refund, if due, will be issued within 14 days’ time of WYBE’s refund decision.

WYBE shall not be obliged to make any refunds for services already performed or partially performed.

6. Client Responsibilities

You agree that:

• you will provide true information regarding your medical conditions, injuries, medications, allergies or any other restrictions pertinent to your training;
• you will follow the safety recommendations and not perform any of the exercises recommended by us that can cause unpleasant side effects such as sharp pains, fainting or anything else unusual;
• you will arrive to personal training sessions on time, prepared to train, hydrated and dressed appropiate for the training;
• you shall keep your account details, program content, or any assessment information WYBE shares with you confidential and not share or distribute WYBE content, programs or Apps.

7. Limitation of Liability

WYBE, its parent, subsidiary, affiliated or related companies, directors, officers, employees, contractors, agents, representatives or assigns shall not be liable to you for any indirect, incidental, consequential, punitive or exemplary damages, or for any loss of income, profits, goodwill, data, revenue, opportunities, savings or any other intangible losses of any kind, whether foreseeable or not or any loss or damage resulting from or occasioned by your inability or failure to use any WYBE service, program or Website.

WYBE’s aggregate liability to you for any claim, demand or proceeding, including any liability of its parent, subsidiary, affiliated or related companies, directors, officers, employees, contractors, agents, representatives or assigns, shall not exceed the amount of fees actually paid by you to WYBE for the services that give rise to such claim, demand or proceeding during the 12-month period preceding the event giving rise to such liability, unless prohibited by UAE law.

Nothing in these Terms shall exclude or restrict WYBE’s liability for death or personal injury caused by gross negligence, fraudulent misrepresentation, or any liability that may not be excluded under applicable law.

8. Intellectual Property

All information, material, data, and content on our Website, program documents, videos, nutrition content, etc., provided by us to you are protected by copyright law and are our sole intellectual property. You are prohibited from distributing, copying, reproducing, publicly performing or displaying any of it without our express consent. However, you may take screenshots and post them on social media or quote excerpts of our material, providing us with credit.

9. Photos & Testimonials

WYBE may ask you for permission to use your progress photos, testimonials, and/or appear in the videos we produce.

This permission can be revoked at any time by you by notifying us, whereupon WYBE will remove your content from their resources. Exceptions are content already published by third parties, which this revocation will not affect, and content already printed or published by third parties. It takes up to 2 working days for us, upon your written notice, to remove your content from our web resources.

10. Governing Law, Disputes

These Terms shall be governed by and construed in accordance with the laws of the UAE and the laws of Dubai, and any dispute arising out of or in connection with these Terms or the services provided by WYBE shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

11. Changes to Terms

We reserve the right to update, modify or amend these Terms at any time and in our sole discretion. The updated version will be indicated by the “Last updated” date at the beginning of these Terms. We will endeavour to notify our clients by e-mail about any material changes to these Terms, and your continued use of our services will be deemed to be your acceptance of these Terms.
